2- Collection of Personal Information that makes user identifiable
I. The provider may collect and process the following information about the user, including the user name, email address, mobile number, postal address, geo-location, social media handles, professional details, including but not limited to any registration number, expertise, experience etc., personal information related to legal problems, queries, emergencies etc. that the users provide by registering and using the digital products.
II. The provider may also keep record of any data generated or uploaded by the user while using the digital products, like the user preferences, documents, downloads, connections, queries, searches, calls, payments etc.
III. The provider may request any other information from time to time to enhance the efficacy of the digital products, or betterment of user experience, or for any other purpose benign to the users.
IV. The provider also maintains the details of every transaction made by the user through the digital products, as well as store financial data of some users, like bank account details, GST number etc.
V. The provider may promote or advertise certain products or services of their own company or of any other company within the digital products and display to the users. Any user may explicitly express interest in the advertised product or service and wish to explore it further. The data of the explicit expression of such interest is captured by the Provider.
3- Collection of identity agnostic Information
The user cannot be identified solely from this information and it is only used to assist the provider in providing an effective service through the digital products and to collect broad demographic information for aggregate use.
I. The provider may automatically collect certain information about the user as and when the user accesses or uses the digital products, such as the device type, operating system, internet browser, source of the user traffic, redirecting online media, app store etc.
II. The provider may also collect the users’ IP address or the unique identifier which are, subsequently, automatically recognised by the provider’s servers.
4- Usage of personal and identifiable information collected
The provider may use the information collected as per point 2 in the following manner:
I. For the purpose of providing better user experience of the digital products, the provider shall use the information provided by the user to build a profile of the user as per their preferences, search, and content consumption patterns
II. Data is also recorded for future audits and swifter log-ins for existing users.
III. The provider shall keep detailed records of transactions for every user to deliver the appropriate features, services etc. for the correct duration, as per the payment received. Transaction data is also used by the provider to generate appropriate invoices that also help the users in their accounting purposes.
IV. The bank account details of some users may be utilized by the provider for making payments to the users’ bank account in lieu of rendering certain services to the company.
V. GST data, voluntarily provided by the user, shall be used to generate invoices or payment vouchers etc. for accounting compliances of the company as well as the user.
VI. The provider may collect information of the individual users’ interest in advertisement and promotions displayed to them and use the data to gauge the users’ preferences to display advertisement and promotions of such products or services that appeal more to the users, individually.
VII. Upon explicit expression of interest in the advertisement of certain products or services displayed in the digital products the provider may share the contact details (name, mobile number, email address) of such users with certain advertisers.
5- Communication with the users:
The provider may send the following communication to the users collectively, or individually:
I. Notifications for utility or promotional purposes via the App to its user;
II. Emails for the purpose of providing information, or marketing certain offers, products, or services, or utility messages related to updates, access, or usage of the digital products;
III. Phone calls to user for any assistance or communication that requires to be done via phone calls
IV. Messages for utility or promotional purposes via instant messengers like WhatsApp, Telegram, Discord etc. and SMS
6- Security:
I. The provider shall take all the necessary steps and precautions to protect the personal data of the user that makes him/her identifiable as any reasonable person shall take to protect their own data of the same nature;
II. The provider shall adhere to all the compliances required as per the prevalent laws with respect to security of all kinds of user data that is collected in due course of users’ access and usage of the digital products.
7- Obligations to the Government:
I. In the event of any lawful requisition of data by the Central Government or any State Government of India, or any of their competent agencies, the provider is obligated to provide data to such government or agency regardless of the nature of the data involved;
II. Depending on the nature of such request, the provider may not be obligated to notify any individual user or users about such data being shared
